FINRA asked the SEC to review fixed indexed annuity (FIA's) and the sales practices of these products to determine whether or not they are securities. On December 17, 2008, the SEC voted to adopt Rule 151a. This rule makes fixed indexed annuities a security effective January 12, 2011. However, the industry is fighting back. A federal appeals court will begin to hear oral arguments on May 8, 2009, on a suit challenging the SEC's position on 151a. We at Annuity Marketing Services are confident the industry will prevail.
